KINKONISM PRIVACY POLICY Last updated: March 2026
KINKONISM (“we,” “our,” or “us”) is committed to protecting your privacy and providing clear terms for the use of our services. This Terms & Privacy Policy outlines the rules governing your use of our website and services, as well as how we collect, use, disclose, and safeguard your information. It is governed by the Swiss Federal Act on Data Protection (nDSG) and, where applicable, the EU General Data Protection Regulation (GDPR).
1. WHO WE ARE
The data controller responsible for your personal data is:
KINKONISM [Beyond Productions Gmbh] Zürich, Switzerland info@kinkonism.ch
For any questions regarding this policy or your personal data, please contact us at the above address.
2. INFORMATION WE COLLECT
We may collect the following types of information:
Personal information: Name, email address, and contact details when you sign up for membership, newsletters, events, or submit inquiries.
Event data: Information provided during event registration, including age verification details.
Membership data: Details provided when joining our membership programme, including your name, email address, answers for approval, membership tier, payment details (processed securely by our payment provider), billing history, and your marketing preferences.
Sensitive personal data: By nature of our events, some information you may provide — including details that may relate to your s3xual orientation, gender identity, or lifestyle preferences — is classified as sensitive personal data under Swiss nDSG. We collect and process this data only with your explicit consent and apply the required security standards to its protection.
Usage data: Automatically collected data including IP address, browser type, device information, and pages visited on our website.
Cookies and tracking technologies: Data collected through cookies to enhance user experience and analyze web traffic. See Section 7 for full details.
3. LEGAL BASIS FOR PROCESSING
We process your personal data on the following legal grounds:
Consent: Where you have given us explicit consent, for example when signing up for our membership, newsletter, registering for events, or agreeing to the processing of sensitive personal data.
Contract: Where processing is necessary to fulfill a contract with you — including the administration of your membership, processing of payments, and delivery of member benefits.
Legal obligation: Where we are required to process your data to comply with Swiss law.
Legitimate interests: Where processing is necessary for our legitimate interests, such as improving our website and services, provided these interests are not overridden by your rights.
You may withdraw your consent at any time by contacting us at info@kinkonism.ch. Withdrawal does not affect the lawfulness of processing carried out before withdrawal.
4. HOW WE USE YOUR INFORMATION
We use your data to:
- Provide, maintain, and improve our services and website.
- Administer your membership, including processing payments, managing renewals, and communicating changes to your membership.
- Communicate with you about events, updates, and promotional content relevant to KINKONISM.
- Verify age eligibility for our events (18+ only).
- Comply with legal obligations.
- Protect the safety and security of our community.
We will never use your data in a way that is incompatible with the purposes stated above without first obtaining your consent.
5. MEMBERSHIP
KINKONISM offers membership on a free, paid, or annual subscription basis. This section explains how we handle your data specifically in the context of membership.
5.1 Data collected at sign-up
When you join as a member, we collect your name, email address, and — for paid or annual memberships — payment information. Payment data is processed directly and securely by our third-party payment provider and is not stored on our systems in full.
At sign-up, we will ask for your explicit consent to receive promotional communications from us, such as event announcements and offers. This consent is separate from your membership agreement and is entirely optional — you can be a member without receiving marketing emails.
5.2 Payments
All membership purchases are final and non-refundable. Once payment has been processed, no cancellations or refunds will be issued.
Your payment details are processed securely by our payment provider. We retain a record of your billing history (amounts, dates, and membership tier) for accounting and legal compliance purposes.
5.3 Cancellation and deletion of membership data
If you cancel your membership or delete your account, we will handle your data as follows:
- Active membership data (name, email, preferences): Deleted or anonymised within 30 days of your cancellation or deletion request, unless we are required to retain it for legal purposes.
- Financial and transaction records: Retained for 10 years in accordance with Swiss accounting law (OR 2020), even if you delete your membership. This data is kept in a restricted, non-active state and is not used for any marketing or operational purpose.
- Marketing consent: If you had opted in to promotional communications, your consent record and email address will be retained in a suppression list to ensure we do not contact you again, unless you re-subscribe.
- Event participation records: Anonymised upon membership deletion unless you attended a ticketed event, in which case basic transaction records are retained for the legal retention period above.
To request deletion of your membership and associated data, contact us at info@kinkonism.ch.
6. SHARING YOUR INFORMATION
We do not sell or rent your personal information. We may share your data only in the following circumstances:
Service providers: Trusted third-party providers who assist us in website operations, email management, or payment processing. These providers are contractually bound to process your data only per our instructions and in accordance with applicable data protection law.
Legal requirements: Where required by Swiss law, in response to legal processes, or to protect the rights, property, or safety of KINKONISM, our community, or others.
We will never share sensitive personal data — including anything relating to s3xuality, gender identity, or lifestyle — with any third party beyond what is strictly necessary to provide our services.
7. INTERNATIONAL DATA TRANSFERS
Some of our service providers — such as email platforms, analytics tools, or payment processors — may be based outside Switzerland or the European Economic Area. Where this is the case, we ensure appropriate safeguards are in place, such as EU Standard Contractual Clauses or adequacy decisions recognized by Swiss law, to protect your data. You may request details of these safeguards by contacting us at info@kinkonism.ch.
8. COOKIES
Our website uses the following types of cookies:
Essential cookies: Necessary for the website to function. These cannot be disabled.
Analytics cookies: Help us understand how visitors interact with our website. These are only activated with your consent.
Marketing cookies: Used to deliver relevant content. These are only activated with your consent.
You can manage or withdraw your consent to non-essential cookies at any time via our cookie settings banner or by adjusting your browser settings. Note that disabling certain cookies may affect your experience on our website.
9. DATA RETENTION
We retain your personal data only for as long as necessary to fulfil the purposes outlined in this policy. Specifically:
- Membership and marketing data: Retained until you cancel your membership, unsubscribe, or withdraw consent — after which active data is deleted within 30 days (see Section 5.3).
- Financial and transaction records: Retained for 10 years in accordance with Swiss accounting law.
- Website usage data: Retained for up to 13 months.
After these periods, your data is securely deleted or anonymized.
10. PHOTOGRAPHY AND FILMING
For the privacy and safety of all attendees, photography and filming by guests is strictly prohibited at KINKONISM events.
When KINKONISM or authorised photographers capture images or video at our events, they will ask for your explicit verbal consent before photographing or filming you. Images will be shared in our members-only website section and may be used for promotional purposes on our social media channels. We will never publish content in which you are identifiable without having obtained your verbal prior consent.
You may revoke your consent and request removal of any published image or video at any time by contacting us at info@kinkonism.ch or via our Instagram. We will action your request promptly.
11. YOUR RIGHTS
Under Swiss nDSG and, where applicable, GDPR, you have the right to:
- Access your personal data and receive a copy of it
- Correct inaccurate or incomplete data
- Delete your personal data (“right to be forgotten”)
- Restrict the processing of your data in certain circumstances
- Data portability — receive your data in a structured, machine-readable format
- Object to processing based on legitimate interests
- Withdraw consent at any time without affecting prior processing
To exercise any of these rights, contact us at info@kinkonism.ch. We will respond within 30 days. We may need to verify your identity before processing your request.
If you believe your data protection rights have been violated, you have the right to lodge a complaint with the Swiss Federal Data Protection and Information Commissioner (FDPIC) at fdpic.ch.
12. DATA SECURITY
We apply industry-standard technical and organizational security measures to protect your personal data from unauthorized access, loss, or misuse. Given the sensitive nature of some of the data we hold, we apply security standards accordingly.
However, no method of online transmission is 100% secure and we cannot guarantee absolute security. We will notify you and the relevant authorities in the event of a data breach as required by law.
13. THIRD-PARTY LINKS
Our website may contain links to third-party websites. We are not responsible for the privacy practices or content of those sites and encourage you to review their privacy policies independently.
14. MINIMUM AGE
KINKONISM’s website and services are strictly intended for users aged 18 and older. We do not knowingly collect personal data from anyone under 18. If we become aware that we have done so, we will delete it immediately.
15. CHANGES TO THIS POLICY
We may update this Privacy Policy from time to time to reflect changes in law or our practices. The date at the top of this page will always reflect the most recent version. We encourage you to review this policy regularly and will notify you of significant changes where required by law.
